Third warrant of arrest

Tabani Mpofu, Felix Matsinde, Mehluli Tshuma, all former public prosecutors, and Warship Dumba, a former Harare city councillor are facing charges of impersonating the police, possessing articles for criminal use and breaching the Official Secrets Act.

The driver, Zororai Mudariki yesterday failed to appear in court to be subpoenaed to appear on the next remand date.
The secretary to the Prime Minister and Council of Ministers, Ian Makone yesterday wrote a letter to the court asking the State to excuse Mudariki as he was travelling to Kariba.

However, Prosecutor Mr Michael Reza told the court that Mudariki was not taking the court’s business seriously.
“Your Worship, in terms of section 231 of the Criminal Procedure and Evidence Act, only the court can excuse a witness who has been properly subpoenaed or warned by the court to appear in court and nobody else.

“If you look at the record, it would be his third warrant of arrest and this shows that he does not take the court’s business seriously. It is the State’s prayer that a warrant of arrest be issued in spite of the letter by Mr Makone,” said Mr Reza.
