Mbare magistrate Mr Stanford Mambanje on Friday failed to deliver judgment in the matter of a police woman who is accused of assaulting a community service officer at Mbare Magistrate’s Court because he had overwhelming work and was not able to finish writing the judgment. “I am not yet done with the judgment, I am left with just a few things. The judgment will be ready on Monday,” he said.
However, Babra Chipatiso (28) appealed for the matter to be remanded to December 16 saying she had other matters being heard at the Harare Magistrate’s Court. “I cannot attend court on Monday and Tuesday because I have other cases at Rotten Row,” she said.
Chipatiso is accused of throttling a community service officer who had restrained her from insulting her supervisor. The matter was remanded to next Wednesday. The prosecutor Mr Lawrence Gangarahwe alleged that on November 4, Chipatiso in the company of her colleague approached Shingirai Matavire who was in her office at Mbare Magistrates’ Court.
It is alleged that Chipatiso asked Matavire’s supervisor for community service records of an ex-convict, Solomon Mombeshora, who was convicted of culpable homicide in 2011.
Matavire’s supervisor allegedly told Chipatiso that the records that she was looking for had been taken to the Harare Magistrates’ Court by the director of community service.
It is the State’s case that Chipatiso began shouting at Matavire’s supervisor accusing her of defeating the course of justice. The court heard that Chipatiso detained Matavire’s supervisor preventing her from going for lunch.
Allegations are that Chipatiso ended up throttling Matavire. The matter was reported to the police leading to Chipatiso’s arrest.
