FOR Fildah Mushonga, there was just one thing to blame for her failure to attend a court hearing – a TOILET.
She claimed she took longer to leave the toilet because she was experiencing menstrual pains.
Mushonga filed this in her application for a review of an order by a Chitungwiza magistrate.
It was granted after she failed to attend a maintenance upward variation case against her ex-husband Priston Maporisa.
“I wish to state that I was not in wilful default when judgment was passed.
“On this day, I was on my menstruation.
“During this period, I always have complications which include painful and persistent bleeding.
“I visited the toilet and took too long to come out.
“On my way out, I went to the Clerk of Court to advise him accordingly.
“The court was already in session and, when I entered, my case had already been concluded and judgment passed,” reads part of Mushonga’s application.
Her application will be heard on October 19.
Mushonga is demanding US$800 per month from a local businessman, known as Maporisa.
Maporisa told the court, through his lawyer, that Mushonga was denying him access to his 11-year-old child.
The court granted Maporisa’s request to enrol his child in a boarding school for him to have easy access.
