TRIAL TO RESUME AS KOMBO’S OBJECTION IS OVERRULED

IVY Kombo and her husband, Admire Kasi, have had their objection to the tendering of an email allegedly sent by their accomplice, Huggins Duri, as evidence. overruled by the magistrate presiding over their fraud trial.

The couple and former Council for Legal Education (CLE) executive secretary, Duri, are being tried for allegedly paying for conversion certificates for Kombo and Kasi without them taking the required CLE exams.

The State argued that the email is significant because it allegedly contains a list of names, including the couples, for the certificates to be issued.

The controversy between the State and the trio was on admitting the email as evidence, with the defence lawyers arguing that it was not served on them at the commencement of trial.

Magistrate Feresi Chakanyuka didn’t read the full reasons for admitting the email, but said the defence didn’t state the prejudice it would suffer if the email was tendered.

She, however, stressed that the State had a duty to prove the authenticity of the email.

The trial is set to resume on March 4.
