“We act on behalf of Kwanele Muriel Jirira and Loius Masuko who obtained an order against the University of Zimbabwe for payment of US$291 214 13.
“We hereby serve you with a court application for a garnishee order in respect of the said bank account.
“In accordance with order 42, rule 3881 of the High Court rules the effect of service of a court application for a garnishee order is to bind all the amounts,” read part of the letter.
The lawyers said effectively the bank was required at law to freeze the bank account until the High Court orders otherwise and no withdrawals or transfers could be carried out on the attached bank account.
UZ was ordered to pay Jirira US$156 852 13, Masuko US$134 362 and their lawyers in terms of applicable tariff set by the Law Society of Zimbabwe. Jirira and Masuko say they were employed by UZ as research fellows based at the Institute of Development Studies which was restructured.
The pair was redeployed from the institute to the economics department.
They however, argued that such redeployment was unlawful, their contracts of employment and the terms and conditions do not allow for such.
The two argue that they did not have qualifications to teach in the department although they fulfilled the duties while refusing to take up offices in the department.
The two were called to a disciplinary hearing where they were found guilty and fired.
Through their lawyers they approached the Labour Court where they were granted the arbitral awards.
The judge ruled that they were unfairly dismissed.
