Unrepentant thief gets 2 years

Edward Muhenyeri (34) pleaded guilty to unlawful entry when he appeared before provincial magistrate Mr Kudakwashe Jarabini recently who convicted him on his own plea of guilty.
Mr Jarabini sentenced him to three years imprisonment of which eight months were suspended on condition of good behaviour and further four months were set aside on condition he restitutes US$100 on or before September 30 this year.
In his ruling, Mr Jarabini said the offence was a well calculated and premeditated one because Muhenyeri got into the premises illegally and was only arrested while in the ceiling.
“Unlawful entry into premises is a serious offence that is prevalent hence the sentence imposed should send the correct message to would be offenders so they that they will not commit the same.
“The accused is not a first offender, he has series of convictions dating back to 1996 as clearly shown by documents from the Central Criminal Bureau,” he said.
He said it was an indication that Muhenyeri was an unrepentant criminal whose conduct warrants a deterrent sentence. The complainant in the matter is Wardrobe Mix represented by Mr Wellson Chipameso who is the owner. The agreed facts are that on August 5 this year the complainant closed his shop and locked all doors and windows.
He left everything intact and activated the alarm system. Mr Chipameso was called by the Safeguard response team who told him that his alarm was on and he rushed to the shop at 12 midnight.
When he arrived he found the Safeguard reaction team already on the scene and he checked his shop and found Muhenyeri in the ceiling.
He did not steal anything but he caused damage to the ceiling needing US$100.
