The family row over the ownership of Waverley Blankets and Plastics yesterday saw Harare regional magistrate Mr Taurai Manuwere upholding an application for exception and acquitting Waverley boss Aron Vico of the fraud charges held against him.
Mr Manuwere agreed that the facts on the charge sheet did not show Mr Vico had committed any offence.
The complainants were sisters Amanda Berkowitz and Belynda Halfon who had roped in a private prosecutor Charles Warara into the trial, then later changed to Tendai Biti’s law firm.
The sisters were accusing Mr Vico of fraudulently assuming ownership of Waverley. They had approached the court seeking to set aside the allotment of shares that gave Mr Vico power to take over Waverly.
But Mr Vico denied the allegations and through his lawyer Admire Rubaya filed his application for exception, saying the charges he was facing did not disclose an offence.
Mr Manuwere agreed and ruled in favour of Mr Vico finding no offence and that Mr Vico was not guilty.
