A HEADLANDS farmer, Simbarashe Sphiwe Chimonyo, who made headlines last month after she allegedly violated two graves of minor children at her farm was finally arrested and arraigned before the courts, with her lawyer claiming that she is a mental patient. Chimonyo (56) of Moreson Farm who is represented by Mr Leornad Chigadza of Chigadza and Associates is facing a charge of violating a grave as defined in Section 110 of the Criminal Law (Codification and Reform Act), Chapter 9.23
Chimonyo was not asked to plead when she appeared before Rusape provincial magistrate, Mr Shingi Mutiro, who advised prosecutor, Mr Thomas Tumbare, that she should be examined by two State doctors and their findings be made available on the next trial date.
Mr Tumbare told the court that Chimonyo forced an employee to exhume the remains of his child who was buried seven months ago and rebury them elsewhere.
“On December 27, 2015 at around 9am, the accused person instructed the complainant, Peter Chakaora to exhume the remains of his son he had buried at Moreson Farm on May 26, 2015 for reburial at Chimonyo’s proposed site. Chakaora refused as the order was unlawful. Before burying the body Chakaora was granted permission to do so by Grant Hofmeyer through the farm supervisor, Never Sibanda.
“Grant was acting on behalf of Chimonyo as he is a farming tenant at the farm. He is farming part of the place where the burial was done. On December 27, 2015 at around 4.30pm, the accused called the complainant to the gravesite and forced him to exhume the remains of his son. He was ordered to put them in a plastic bag. This was against Chakaora’s will, thereby violating a grave,” said Mr Tumbare.
Chimonyo was expected to appear in court again yesterday (Thursday).
