Woman claims US$2 000 in adultery damages

US$2 000 in adultery damages from her husband’s 22-year-old girlfriend.
Alice Mabika told the court that Patience Vushe was staying with her husband.
“Defendant is staying with my husband and I have told her that I am married to him in terms of Chapter 5:11 (of the Marriages Act) so I am claiming US$2 000 as adultery damages.
“The damages are for disturbing my stay with my husband and interfering with my marriage.
“I have been deprived of conjugal rights and I have lost love and compassion because of her,” she said.
She told the court that her husband, George Mabika had neglected the family because of Vushe.
“In June 2010, I warned her that I was legally married to George but she ignored me.
“My mother-in-law also notified her about the marriage and that is when my husband moved out to stay with her,” she said.
Vushe, however, denied the allegations arguing that she was not aware of the marriage.
“I was not aware that George was married as I sometimes called him during the night.
“I cannot afford to pay the US$2 000 and I have no problem if George moves back to his wife,” she said.
Magistrate Ms Barbra Chimboza heard the matter and deferred it to April 4 for ruling.
