A 25-YEAR-OLD Bulawayo man yesterday appeared in court for allegedly raping his 45-year-old neighbour who was relieving herself in a toilet.

Wellington Kapoka of Nketa suburb allegedly raped his neighbour after stripping her in the toilet.

Kapoka appeared before West Commonage provincial magistrate Abednico Ndebele facing a charge of rape.

Ndebele remanded him in custody to January 11, 2016.

Kapoka denied the charge saying the victim invited him to have sex.

“She invited me to have sex with her. I refused but she insisted and told me that we’ll do it undercover. I told her that I’m too young,” said Kapoka.

Prosecuting, Mufaro Mageza said on December 25, 2016 at around 12AM in Nketa suburb, Kapoka had sexual intercourse with the woman without her consent.

“Kapoka pounced when the complainant was relieving herself. He forcibly removed the complainant’s panties and had sex with her,” said Mageza.

He said the woman tried to fight him but she was overpowered.

“Kapoka locked the toilet door from inside then grabbed and pushed the complainant down. She was rescued by her children and other housemates who heard her screaming in the toilet,” said the prosecutor.
