She said she wedded the man under Chapter 37 of the Marriages Act.
Tsitsi Chiyangwa brought to court Miriam Chiyamba seeking a peace order against her.
She told the court that Chiyamba was almost the same age with her last born child.
In this case she wanted Chiyamba off her husband.
“Magistrate, please tell this woman that the man belongs to me alone, he is my property and I don’t want any woman near him,” she lamented.
“Here is my marriage certificate, I am legally married to this man under Chapter 37.
“This woman is disturbing my peace by having my husband at her place.
“He knocks off at 5pm, but only comes home at 11pm because of her.”
Chiyangwa added that her husband was old enough to be Chiyamba’s grandfather.
“Andrew is my husband, please tell her that I am not happy,” said Chiyangwa.
“My original marriage certificate is at her house while I am using photocopies. I am suffering in the rural areas while she is making my husband look after her other children,” she said.
In her response, Chiyamba told the court she has a child with Chiyangwa’s husband.
“I started seeing this man in 2009 and we have a child together. I have never in any way been violent to her but she is violent towards me and causing havoc at my home,” she said.
Magistrate Ms Vongai Muchuchuti told Chiyangwa that the court had no power to direct Chiyamba to leave her husband.
“I understand there is a matter pending for adultery damages, this is when you can recover money for pain and suffering.
“Your application is dismissed but I need the two of you in my office for counselling,” she said.
