MDC–T chief elections agent Morgen Komichi, who is facing charges of fraud and contravening the country’s electoral laws, yesterday accused the Zimbabwe Electoral Commission of hatching a plan to cause his arrest. Komichi said this while being cross-examined by chief law officer Mr Michael Mugabe on his evidence that he gave to the court.
“They took advantage that I was alone when I met them over the issue and they knew that when we come to court it would be my word against theirs,” he said.
“This is why Mr (Utoile) Silaigwana (Zec deputy chief elections officer) lied against me when he testified in court because he was doing a duty he was sent to do by Zec.
“When Zec officials sat down and realised that there could be an offence for which they could nail me down, they ran to newspapers and the Internet giving out information.”
Komichi was cautioned by Mr Mugabe and warned that he should answer questions and not volunteer information.
He said he wanted to be allowed to answer questions in any way he wanted.
“I am appealing before you ‘Gushungo’ that I may be allowed to answer questions in a way I feel is best for me since there are no set rules on how to answer questions,” said Komichi.
Magistrate Mr Tendai Mahwe advised Komichi to answer questions as they were asked and not offer explanations when the answer needed was a simple yes or no.
Komichi was asked by Mr Mugabe if the documents he presented to Zec were authentic, to which he replied that he did not know since he took the ballots to Zec for verification. Mr Mugabe produced Komichi’s notice of opposition that he filed at the Constitutional Court which was attached to the ballot papers.
