In an urgent chamber application filed at the High Court, the firm, which is an agent for NetOne entered into a contract with Business Equipment Corporation Limited.
Under the contract, Zellco claimed it would allow the company to use NetOne mobile phone lines for a fee determined by the tariff set by the Postal and Telecommunications Regulatory Authority.
Zellco through its lawyers Kantor and Immerman claims that part of the agreement was the company would use the mobile lines and pay for the service.
In January 2009, Zellco says it was granted a Foliwars licence by the telecommunications sector after the introduction of the use of foreign currency in the country.
“Advertisements were flighted in major newspapers notifying clients of the new tariffs and new terms of the contract.
“Text messages were also sent out stating that the contract was now dominated in US dollars,” Zellco says.
However, BEC, says Zellco breached the terms of the contract in September 2010 when it refused and neglected to pay for the services rendered.
“Dating back to September 2010 the debt of the services rendered to Business Equipment Corporation Limited amount to US$4 891,88 as calculated in terms of the NetOne POTRAZ approved tariff,” Zellco claims.
Zellco is also claiming interest at the rate of 5 percent per annum from the date of issue of summons up to the date of full payment as well as costs of suit. BEC is yet to respond to the application. Justice Bharat Patel will preside over the case.
