ZimRights had gone to court challenging the Zimbabwe Electoral Commission decision barring the organisation from observing the referendum on the grounds that it was facing criminal investigations.
However, during a chamber hearing Justice Mavangira granted ZimRights the relief it sought by consent of both parties’ lawyers.
Before the order was granted, the judge requested ZEC to re-constitute and assess ZimRights’ application afresh.
This was after the court made a judicial notice that ZEC had failed to observe the law and infringed upon procedural rights.
Some civic organisations on Wednesday petitioned the principals threatening to boycott the referendum after Zimbabwe Election Commission had turned down a request by ZimRights to observe the referendum as the organisation was facing criminal investigation.
