A 29-year-old Nyamandlovu man who raped a 30-year-old woman who is mentally challenged and incapable of giving consent to sexual intercourse has been sentenced to 20 years in prison.
Siphamandla Nkomo of Mkhokheli Sikhosana’s plot Forester, appeared before Bulawayo regional magistrate Mr Mark Dzira facing a charge of rape as defined in Section 65(1) as read with Section 64(3) of the Criminal Law Codification and Reform Act Chapter 9:23. He was found guilty as charged.
In passing the sentence, the magistrate ruled that the accused person took advantage of the complainant’s condition and slapped him with 20 years jail sentence.
Prosecutor, Mr Jethro Mada told the court that on January 6, 2026 at around 11AM, the accused person dragged the complainant into the granary and went on to remove her clothes and raped her once.
The court heard that the matter came to light when the complainant’s sister heard the complainant screaming and went into the granary and saw the accused persons lying on top of the complainant.
“The following day at around 4:50PM, the complainant was escorted to file a report at Zimbabwe Republic Police Nyamandlovu, leading to the arrest of the accused person,” said Mr Mada.
The complainant was then referred to Nyamandlovu Hospital for medical examination and treatment. The medical report was produced in court as an exhibit.
