In his defence, the man claimed that there was never a day he was left alone in custody of the girl.
The court, however, convicted him after prosecutor Ms Joice Fusire proved the case against him beyond any reasonable doubt.
Ms Chivasa sentenced the man to 12 years in prison but suspended four years on condition he shall not commit a similar offence in the next five years.
Circumstances were that on the period stretching from May to August in 2008, the girl was staying with her aunt in Chitungwiza. During her stay, her aunt left the house leaving the girl in her husband’s custody.
The man invited her to sit in the dining room where he was watching some movies on his computer.
The man began playing pornographic material and asked the girl to join him and she complied.
After that, he demanded oral sex and threatened to kill her if she refused or revealed his assault to anyone.
He gave her some Zimbabwean dollars to conceal the offence.
On another date unknown to Ms Fusire, the man employed the same method and raped the girl. The matter came to light when the girl developed warts on her genitals and informed her aunt who reported the matter to the police leading to the man’s arrest.
