Abusive hubby assents to protection order

A Mutare woman approached the Civil Courts praying for a protection order following incessant bashings from her husband.

Appearing before magistrate, Mrs Yeukai Chigodora, Patricia Magaragade begged the court to protect her from her abusive and violent ex-husband, Stewart Bakare whom she alleges is in the habit of assaulting, insulting and even threatening to kill her.

“I am tired of Bakare’s violent behaviour, Your Worship. He assaults me together with my children for no apparent reasons.

“At one time he throttled me for about 20 minutes while shouting on top of his voice that he wanted to kill me. He is a drunkard. He always comes to my place of residence at midnight disturbing my peace. He is in the habit of assaulting and insulting me.

“He also pours cold water in my blankets, Your Worship. I don’t know what type of a husband is he? I am tired and I now need the law to protect me,” said Magaragade.

Asked to respond to the allegations which were levelled against him, Bakare told the court that he was surprised to be called ex-husband yet he was still living with her.

“I admit that I am abusing her, but what surprises me now is hearing her calling me her ex-husband, yet we are still living together as husband and wife,” said Bakare.

Magaragade also stated that Bakare forcibly stays with her despite having said she would poison him with rat poison for him to vacate the premises.

“This man has made my life a living hell. He forces me to stay with him as he always told me that I should poison him so that he will vacate my father’s premises where I am currently residing.

“He comes to my place of residence disturbing my peace, therefore I now need the law to protect me. He does not even pay rentals for his children and even buying food,” said Magaragade.

However, Mrs Chigodora granted the order baring Bakare from any violent acts to his ex-wife and advised her to file the proper application if he is neglecting his family.

“The order is hereby granted in which the respondent is barred from doing any harmful acts which disturbs the complainant’s peace. Madam, for your application is in the wrong court, you better apply for maintenance if he is neglecting his children,” said Mrs Chigodora.
