adminjudge Justice Tedious Karwi sitting on circuit here on Friday sentenced Muchakata Mupfiga (43) of Nhopi Village in Nyakunhuwa communal lands to 12 years in jail but suspended two years.
Mupfiga was convicted on two counts of murder after he killed Peter Mabika and Innocent Muregi at a Zanu-PF campaign base at the business centre. Two other party activists, Takudzwa Mazhetese (31) and Moses Binduko (34), from Ranganai Village under Chief Nyakunhuwa were jailed for four years each for culpable homicide.
In sentencing the trio, Justice Karwi also took into account that they had been on remand since 2002.
They were indicted for trial at the High Court in September last year and were denied a chance to stand trial within a reasonable time. Mr Nickel Mushangwe of Mushangwe and Company had in mitigation submitted that the trio was denied its constitutional right to stand trial within a reasonable time. They were in remand prison for nine years. Mupfiga and his accomplices went to Mabika’s homestead on March 10, 2002 and abducted him for allegedly stealing cattle belonging to one of the commanders at the base. They took Muregi from his home to their base. They interrogated them in connection with alleged stock theft.
They stripped the deceased and assaulted him using burning plastics.
Mabika’s body was discovered by one of the youths checking on them the following day. Muregi died a few days later. Mr Elson Chavarika appeared for the State.
