adminWorkers’ Union and the Air Transport Union on Tuesday filed a notice of appeal challenging the decision by Justice Lavender Makoni.
Justice Makoni threw out the application on a preliminary point that the workers’ unions had no legal standing to sue on behalf of the workers. In the notice of appeal filed at the Supreme Court by the workers’ lawyer Mr Caleb Mucheche, the workers argued that the court was misdirecting itself in ruling that the unions had no legal standing.
They contend that the court failed to realise the unions had direct and substantial interest in the matter and that they had a legal standing. The workers’ unions are seeking remittal of the same case back to the High Court for hearing on the merits.
Air Zimbabwe is reeling under a US$140 million debt of which US$35 million is owed to the workers. The workers feel the company should be placed under provisional judicial management after failing to service its debts.
