now failed to pay back. Mufanochiya was recently arrested over fraud charges stemming from the same case and he is waiting for his trial date at the Harare Magistrates’ Court. Barwe has decided to file a civil suit claiming his money back while the criminal case was still pending at the magistrates’ court.
In the summons filed on March 30 this year at the High Court, Barwe says he wants the US$20 000 with interest at the rate of five percent per annum.
Through his lawyers Musunga and Associates, Barwe stated that he loaned Mufanochiya US$20 000 on November 6, 2011 after a special request. According to the summons, on January 23 this year, Mufanochiya signed an acknowledgement of debt in which he undertook to clear the debt by February 29.
Despite acknowledging the debt, Mufanochiya up to now, has failed to pay back. Mufanochiya is expected to file his response to the summons at the High Court before the determination of the matter.
