Bosso treasurer seeks judgment reversal in protracted divorce battle

HIGHLANDERS Football Club treasurer Mr Nkani Khoza has filed a High Court chamber application seeking the reversal and correction of a divorce judgment issued more than a year ago, further deepening a protracted legal battle with his estranged wife of 20 years, Mrs Virginia Khoza.

In the application filed under case number HCBC 1473/25 and dated December 10, 2025, Mr Khoza, through his lawyers Dube-Banda, Nzarayapenga and Partners, is seeking correction of the operative part of the divorce order in terms of Rule 29 (1)(b) of the High Court Rules, 2023, as well as condonation (forgiveness) for the late filing of the application.

Mrs Khoza was served with the application on Monday at around 10am.

Court papers state that the parties were involved in a contested divorce under case number HC 321/21, which was heard in full by High Court judge Justice Bongani Ndlovu. Judgment was handed down on November 29, 2024, under reference HB 169/24.

The judgment subsequently gave rise to further litigation after Mrs Khoza approached the High Court under case number HCBC 02/25, seeking an order interdicting Mr Khoza from resisting the retrieval of cattle she believed had been awarded to her in the divorce settlement.

Mr Khoza argues that Mrs Khoza misinterpreted the original divorce judgment. The matter again came before Justice Ndlovu, who ruled in favour of Mrs Khoza, prompting Mr Khoza to appeal to the Supreme Court under case number SCB 117/25.

The appeal was heard on November 17, 2025, before Supreme Court judges Justices Antonia Guvava, Nicholas Mathonsi and Joseph Musakwa, sitting under case number HCBC 02/25.

The Supreme Court ordered, by consent, that the appeal succeeds in part, with no order as to costs.

The court further set aside paragraph one of the judgment of the court a quo and substituted it with the following directive:
“The respondent is directed not to interfere with the retrieval, by the applicant, of the one-third available head of cattle at Wessels 3 PBS, Thokozani Village, Fort Rixon, or wherever they are, in compliance with the order in case number HB 169/24.”

In the current application, Mr Khoza is seeking relief in the form of a correction to the operative portion of judgment HB 169/24, to explicitly state:
“The plaintiff is awarded four herds of cattle, being one-third of the available 12 herds of cattle, and must make arrangements to retrieve them from the defendant’s homestead or wherever they are within 30 days of this order.”

Mrs Khoza has been given 10 days to file a notice of opposition with the Registrar of the High Court in Bulawayo.
