A HARARE man has dragged his brother before the Harare Civil Court seeking a protection order over a dispute on the ownership of their late father’s house.
Munyaradzi Mudavanhu alleges that his bother Palmer is abusing him, claiming to be the rightful heir to the house left by their late father.
Munyaradzi told magistrate Ms Meenal Narotam that Palmer abuses him verbally and physically, such that he no longer feels safe at the house.
“I am applying for a protection order against my brother,” he said. “This is not my first time to come at this court. We stay in the same house and he shouts at everyone, including my wife.
“He beats me up using fists and open hands and I once reported him to the police and he was arrested, but he fell sick and I had to withdrew the matter.
“Recently, he has become violent and he scolds me using obscene words, saying I am married to a prostitute. He also calls me a son of a prostitute and he destroyed my household property. He once opened the door in the bathroom while my daughter was bathing and chased her.”
Palmer refuted the allegations and told the court that his brother had issues to do with the ownership of their late father’s house.
“I am opposed to all his allegations because if you look at his stature I cannot fight him,” he said. “He is a very strong man and what he has told you is false. On verbal abuse, we exchange words and I think his issue is on the ownership of the house. The problem is that he does not want to be reprimanded, so when I do that he will say that I am abusing him. Our father is late and I was given the powers of attorney so I am in charge of the house and he does not want that. I have no problem with staying with him in harmony.”
Ms Narotam granted the protection order in favour of Munyaradzi and ordered Palmer not to abuse his brother in any way.
