A MAN from Bulawayo has filed a complaint alleging gross incompetence and suspected unethical behaviour at the Law Society, claiming that a local lawyer has interfered with the normal proceeding of the law.
Godfrey Ngaite (pictured), who was employed by TM Supermarket Pvt (Ltd) as a Deli Field Manager in charge of the Southern region and based at Hyper Supermarket claimed that his former employer used forged documents to fire him, adding that the forged documents had different dates.
However, Ngaite submitted a complaint letter on September 2, addressed to the Law Society of Zimbabwe, Supreme Court of Zimbabwe, the Secretary of the Judicial Commission of Zimbabwe and the Constitutional Court of Zimbabwe.
According to the complaint letter, Ngaite alleges that a lawyer has interfered with the normal court proceedings in dealing with his case.
“It is clear in all fair hearing and fair justice and even to the financially challenged parties have justice. It also came to my knowledge that the company TM PicknPay did not only threaten to use the finance to defend its unethical behaviour practices until the fighter loses energy.
“The company erroneously allowed Mr Patrick Ndlovu of the Commercial Workers Union of Zimbabwe (CWUZ) who had no jurisdiction to represent management employees in terms of the NECCSZ Code of Conduct and the National Code of Conduct that is S.I. 15 of 2006,” read the complaint letter.
Ngaite indicated that he was not allowed to attend court until the matter was finalised.
“Due to the financial muscles purported by the company, this saw the Ministry of Labour seating with parties who had no jurisdiction to represent management employees such as Ndlovu and hence hearing the matter and not give a ruling.
“The labour officer advised me to file a condonation to the effect, I did and it was granted. Ndlovu informed me that I am not allowed to attend the court proceedings until the matter is finalised. It also came to light that Ndlovu had the first and second seating only for me to be told of the third seating as the first,” read the complaint letter.
Ngaite indicated that he had to take a loan and get a lawyer to represent him.
“Due to the short time and lack of finance l had to urgently get a loan and I approached Costar Dube, a lawyer from the Dube and Associates Legal practitioners, who on our way to court met (my lawyer) who bravely asked him if l had paid school fees for my children and how much l had paid him to represent me.
“After this short discussion, as we proceeded to court, the utterances of (the lawyer we met) began to take their toll as Dube advised me to drop the case and look for alternative employment somewhere, but at first before we met him, Dube had told me that it was a very simple matter,” read the complaint letter.
He stated that he was appealing to the Law Society to address the challenge that he is facing.
“In all matters, he is standing on my way to justice causing not only the legal aids to turn a blind eye but the judiciary as well. I therefore appeal to the credibility of your Law Society if you still uphold the law and respect humanity as well as your nation and your organisation at large,” read the complaint letter.
