HIGH Court Judge, Pisirayi Kwenda, has varied downwards the State’s list of properties, in line to be forfeited, from former Police Commissioner General, Augustine Chihuri.
However, Chihuri has been ordered to explain how some of his companies in Bulawayo had alleged business links with the police force.
The State had made an application seeking to recover more than US$32 million and forfeit numerous properties allegedly owned by Chihuri, his wife and children.
Some of the properties, which Chihuri will not need to explain, include his Gletwin mansion, worth approximately US$7 million.
His two farms in Chinhoyi and Shamva and farming equipment, several stands and five cars have been spared also.
The operative part of the judgment reads;
“In the result, I order as follows:
“The unexplained wealth order granted by this court on 11 June 2020, under case no HACC 16/20, be and is hereby varied by the deletion of paragraphs 15, 16, 17 and 18.
“The unexplained wealth order granted by this court on 18 June 2020, under case no HACC 20/20, be and is hereby varied by the deletion of paragraphs 7 and 8.
“The State’s counter application in case No. HACC 21/20 is granted as amended,” ruled Justice Kwenda.
The former police chief allegedly sold two of his properties.
Justice Kwenda’s full reasons for judgment are pending.
