Mare had pleaded not guilty to assault charges when his trial opened before Chiredzi Magistrate Mr Thomas Mandityira but was convicted after a full trial.
Mr Mandityira ruled that there was overwhelming evidence that the legislator assaul-ted the schoolboy Michael Tsunguru at a funeral wake in the town in May.
In his judgment Mr Mandityira said there was overwhelming evidence against Mare as corroborated by three key State witnesses. There were inconsistencies in the evidence of three defence witnesses.
In May this year Mare joined a funeral wake in Chiredzi’s Tshovani Township following the death of a staunch MDC-T supporter in the suburb.
Tsunguru, who was among the mourners at the funeral wake, started to sing ‘Nyatsoteerera’ prompting other young boys of his age to sing along.
This incensed Mare who charged at the boy and slapped him once on the right cheek injuring him badly on the ear. A report was made to police leading to Mare’s arrest. Mr Liberty Hove appeared for the state.
This is the second MDC-T legislator in Masvingo Province to be convicted for assault following last year’s conviction of Youth Development, Indigenisation and Empowerment Deputy Minister Tongai Matutu who was convicted of bashing Chief Serima in Gutu.
Matutu was fined US$100.
