Cop positively identifies four MDC activists

on the fateful day.
He identified Yvonne Musarurwa, Nyamadzawo Gapare and Gabriel Shumba.
But he identified Augustine Tenganyika referring to him as Francis Vambai, another accused person among the 29 suspects.
Const Mafavhuke said he had failed to identify Tenganyika because he had seen the accused persons once. “I could have made a mistake by mentioning that name because it has been long since I last saw them,” he said.
Const Mafavhuke was being led by Mr Edmore Nyazamba from the Attorney-General’s Office. He said on the day in question he and Sergeant Chikura and Assistant Inspector Nyararai went to Glen View 4 Shopping Centre to inquire on what was taking place after getting a tip-off by an informer.
He said the people he identified were among 80 MDC-T activists gathered at the shopping centre while donning their party regalia. He said the youths were braaing and drinking beer.
Const Mafavhuke said they summoned the group’s alleged leader Robert Manyengavana and asked him to disperse the crowd as their gathering was not sanctioned.
He said they left after the group promised to disperse. During cross-examination by defence lawyer Ms Beatrice Mtetwa, he said he did not record anything on their visit to Glen View 4 and said the activists were not violent.
He said he only went to the shopping centre once. Ms Mtetwa asked him if he was sure he went there once as his superior Asst Insp Nyararai had told the court that he sent him again to check on the situation.
Const Mafavhuke said he could not comment on what his superior said. He refused to reveal the name and details of their informant.
The matter was deferred to next Tuesday.
Earlier, Ms Mtetwa complained that the defence team was not being treated fairly as they were made to wait and change courts without prior warning. Justice Chinembiri Bhunu said he also faced the same predicament as he was told that morning that his courtroom would be used for Moot Court competitions by university students today.
