Cops probe former deputy sheriff over fake High Court order

It is alleged that a fake High Court order was issued in the case between David Garonga and Hamilton Properties purportedly issued by Justice Felistas Chitakunye to the effect that Hamilton Finance would take steps, including signing of documents to transfer No 442 Goodhope a property that belonged to Tsitsi and Everisto Chitagu, Westgate into Garonga’s name.

The Registrar of Deeds was also ordered to effect transfer of the property from Frank Buyanga to Garonga.
It is alleged that this was a fake order to enable the transfer of Chitagu’s property to Garonga.

However, the Chitagu lawyers Dimba, Jaravaza and Associates wrote a letter in 2010 alleging that Buyanga had fraudulently  caused   the  transfer of their property into Hamilton Property and the property was subsequently transferred to Garonga on  the  strength  of the fake order purported to have  been  granted  by Justice Chitakunye in April 6, 2011 under case  HC5434/11.

It has since been established that the case number is fake as it is a case number of a case between Gold Driven Investments and Rhodes Mhaka.
The authentic case number is 13566/12 which is still pending in court.

A letter written by the Attorney-General’s Office to Buyanga’s lawyer says the property in question was not transferable as the case is still pending in the courts.
The AG’s Office said the transfer is unlawful and ordered that the property be returned to the registered owner until the case is finalised.
