Bande (35) yesterday appeared before Harare magistrate Mr Shane Kubonera facing charges of assault.
He was remanded out of custody to May 17 this year on US$20 bail.
The State led by Ms Svodai Kadivirire had opposed bail and sought to lead evidence from the investigating officer detective sergeant Chinyerere.
However, Det Sgt Chinyerere who is understood to have told the prosecution that he was opposed to bail left the court in stitches when he made a U-turn after being put on the witness stand.
“I have completed investigations and the docket is ready. I have, however, failed to get hold of the complainant and other witnesses in the matter.
“Given the circumstances I am not opposed to bail,” he said.
A shocked Ms Kadivirire submitted that she had no further questions.
Mr David Hofisi from the Zimbabwe Lawyers for Human Rights had applied for bail arguing that his client was a suitable candidate for bail.
It is the State’s case that on January 22 this year the councillor proceeded to the complainant’s house in Stop Over, Epworth in the company of two others who are still at large.
Upon arrival, it is alleged, they met Theresa Rudenga who is the complainant’s wife and demanded to see her husband.
Ms Rudenga called her husband and on seeing him one of the accused only known as Thomas instructed the complainant to sit down but he refused.
It is alleged that the accused persons forcibly pushed him down and started to assaulting the complainant with open hands and kicking him.
As a result the complainant sustained minor injuries all over the body.
