awaiting trial. Tapfumanei Kaitano (26) and Lloyd Samhere (21) were both fined US$200 each by different magistrates.
Magistrate Mr Rodgers Kachambwa sentenced the other accused Nyasha Kaitano to six months in prison which were suspended on condition he pays US$300 fine.
In addition, Nyasha was sentenced to four years behind bars which were wholly suspended on condition of good behaviour.
When Mr Kachambwa convicted Nyasha, he highlighted in the judgment that the minor needed urgent help and asked the prosecutor Mr Michael Reza to facilitate.
The minor’s mother had earlier echoed the same sentiments in her evidence-in-chief.
“Your worship, as a result of the plea by the mother that her child needed help, I contacted Childline and therapy for the child has now started,” said Mr Reza.
Mr Kachambwa said he was grateful that the State took note of the contents of the judgment and facilitated counseling for the girl.
In passing sentence on Nyasha, Mr Kachambwa castigated his behaviour, saying he behaved like “an uncastrated bull”.
“There is a need to pass a deterrent sentence on people who abuse minors. You behaved like an uncastrated bull, you therefore do not expect sympathy from the court,” he said.
Sometime in June around 3pm, Nyasha approached the girl and proposed love to her and she agreed. They had sexual intercourse on that same day and she did not tell anyone.
