Court appoints independent executor for Nzira’s estate

executor to the estate of the late Johane Masowe Wechishanu leader Madzibaba Godfrey Nzira.
Mrs Munangati-Manongwe was appointed after family members failed to agree on an executor of choice.
Two edict meetings chaired by Deputy Master of the High Court Mr Eldrad Mutasa on December 2 and 20 last year failed to yield anything.
This saw the office of the Master of the High Court appointing the lawyer using powers vested in it under such circumstances. This was further compounded by the fact that no will had been filed for record.
In terms of Section 68B of the Administration of Estates Act, the Master of the High Court is empowered to appoint a professional independent executor where parties fail to reach an agreement.
“This certifies that Nyaradzo Priscilla Munangati of Munangati and Associates has been duly appointed the Executrix Dative and is hereby authorised as such to administer the estate of the late Godfrey Nzira,” part of the letter read.
Madzibaba Nzira’s four widows and seven children, together with other relatives who attended the edict meetings chaired by Mr Mutasa, failed to agree on who should be appointed executor.
Madzibaba Nzira’s estate includes Mhundwa Village Shrine in Seke, nine vehicles among them a Mercedes Benz and a Range Rover and a residential stand in Unit O, Seke.
The widows, according to papers filed at the High Court, are Hellen Gadza, Princella Makaza, Sipelile Rushwabwa and Spiwe Hlabati.
Madzibaba Nzira succumbed to hypertension on October 23 last year.
His death came a few months after his release, on health grounds, from prison where he was serving a jail term for rape.
The deceased’s brother, Mr Thomas Nzira, was the one who registered the estate but he was moving for the appointment of the family’s eldest son Ocemega Nzira as executor.
Madzibaba Nzira’s parents Mr Sainet Nzira and Mrs Susan Nzira together with two of Ocemega’s siblings, concurred with Thomas’ suggestion.
On the other hand, one of the widows and her children wanted Mr Thomas Nzira himself to administer the estate.
It also came out from the edict meeting that Madzibaba Nzira wanted Attorney-General Mr Johannes Tomana appointed executor, but he decided to hand over the papers to a lawyer identified as EE Ndlovu.
Some of his family members were pushing for the appointment of that lawyer as executor.
