Bulawayo magistrates’ courts Area Public Prosecutor, Simon Nleya said the case had to be closed after it was found that there was no evidence to support what the supporter, Siboniso Ndebele, was alleging happened.
The two witnesses, who were supposed to support Ndebele’s story, all proffered different versions of what had transpired, and left the State with no option but to close the case.
In his report to the police Ndebele alleged that Dube threatened him with unspecified action and verbally abused him using unprintable words during the half-time break of the Highlanders/Caps United match at Barbourfields Stadium on 8 July.
The matter was first taken to court on Monday but Nleya asked the investigating officer to record statements from people Ndebele claimed had witnessed what transpired.
The case was brought back to court yesterday but the State found that there were no grounds on which to place Dube on remand as there is no reasonable suspicion that a crime had been committed.
