A MAN from Bulawayo has approached the Bulawayo magistrates’ court seeking a downward variation for maintenance payments to his wife saying she is having extra-marital affairs.
Mr Keddious Tarwireyi dragged his wife Patience Dube to court seeking a downward variation from $190 to $100. Tarwireyi was ordered to pay $190 for the upkeep of three minor children in January this year.
“We were staying together peacefully before she came to seek maintenance. She is even having extra-marital affairs. I am a self-employed builder but I have no work at the moment. I own a house but she is the one collecting rent so I have no other source of income,” he said.
Mr Tarwireyi said he could not raise the money he was ordered to pay hence he was seeking a downward variation.
Mr Usheunesu Matova dismissed Mr Tarwireyi’s application saying he should have appealed against the order in January.
“A downward variation is granted when there is change in circumstances of the respondent or his earnings. In this case nothing has changed. The application for downward variation before this court is dismissed,” he said. — @YUshamba
