Deputy Sheriff reclaims property he wrongly attached

Bank of Zimbabwe, is claiming the property.
Polntberg brought the equipment from Beehive Mine in Kwekwe to start operations at Golden Kopje, but the sheriff attached it over a US$25 330 debt owed to NSSA by former owners Casroline.
The Deputy Sheriff, Mr Bulelani Khaka, has since filed an application at the High Court to verify the ownership of the property.
Mr Khaka said he was applying to have it determined and declared if the property attached belonged to Polntberg Manufacturing.
He said during the course of his official duties in execution of writ in case of NSSA and Carsoline Enterprises case number HC2977/11 he attached the property and removed it from Golden Kopje Mine.
The property, he said, included two welding machines, a MWM generator, an Atlas Copco compressor, a five-tonne dumper, a ridgid 535 series and 12-cap lamps.
“However, the ownership of the attached and removed property is being claimed by the first claimant (Plontberg Manufacturing) which said that the attached property belongs to it and was removed from Beehive Mine in Kwekwe to Golden Kopje Mine in Chinhoyi,” he submitted.
Mr Khaka said he had no interest in the case in dispute other than for his charges and costs.
“I do not collude with any of the claimants. I am willing to deal or act in regard to the subject matter of the dispute as the court may direct,” he said.
