Cry (30) and Joshua (38) Mutupanyama took turns to rape the 38-year-old woman between May and July this year.
The three were staying together in a single room at a compound in Mt Hampden. The duo who are facing two counts of rape each, were not asked to plead to the charges when they appeared before Harare magistrate,
Mr Daniel Shonhiwa yesterday. Cry and Joshua were remanded in custody to August 9 for interim remand and their trial date has been set for September 28. Mr Shonhiwa advised the two to apply for bail at the High Court due to the seriousness of their offence.
Prosecutor Ms Vallery Ngoma alleges that sometime in May this year Cry told his wife that he wanted to be intimate with her while Joshua watched. The State further alleged that he ordered her to sleep with his brother Joshua. The woman, the court heard refused to comply with Cry’s demands and tried to run out of the house. Her husband, however, allegedly grabbed her and pushed her to the ground. As they wrestled, it is alleged, Joshua intervened and ordered her to comply before threatening her with death. The woman was raped once by her husband in the full view of Joshua, the court heard.
It is the State’s case that Joshua also raped her once. The prosecution further alleges that sometime in June at around 10 pm, the brothers again demanded to be intimate with the woman. Cry and Joshua threatened her with death and her husband (Cry) raped her first and instructed his brother to follow suit. They took turns to rape her, as she lay helpless on the ground, it is alleged.
The court heard the woman later informed her daughter of the abuse but she could not assist her. On July 21 around 10 pm, the State says, the brothers pounced on her as they wanted to sexually abuse her again.
She, however, managed to sneak out and rushed to the police to report the matter, leading the duo’s arrest.
