A Rusape man who snatched a married woman from her husband has been fined four cattle by a community court.
Talkmore Jambaya of Tsanzaguru was recently dragged to Chief Makoni’s court by Heardwick Mabika of Vengere as he was being accused of snatching his wife.
The woman’s name was not mentioned in court.
Mabika told the court that he stumbled upon Jambaya’s phone number in his wife’s phone and she failed to give him a satisfactory explanation.
Mabika’s suspicions were buttressed when Jambaya’s wife called him and informed him that his wife was cheating with her husband.
“Since June, I have been having marital problems with my wife after I discovered Jambaya’s number in her phone. Her actions and behaviour towards me changed drastically as she was no longer respecting me and also refusing to give me her phone. She also started coming home very late. I raised the issue with her mother and we were invited for counselling.
“She remained at her mother’s place for some days, and to my surprise, she chose not to come back home, but went to stay with a friend.
“She later came back home. My friends informed me that they were regularly seeing my wife with Jambaya, but I did not confront her or Jambaya due to lack of evidence,” said Mabika.
He said at one occasion, he confiscated his wife’s phone and she rushed to her sister and used her phone to inform Jambaya not to call her.
“Her sister later informed me. The sister called Jambaya in my presence and informed him that he was wrecking my marriage. Jambaya responded saying my wife had not disclosed to him that she was married.
“I immediately called Jambaya and asked him why he was dating my wife. He said he had just proposed love to her. He pleaded with me not to pursue the matter any further.
“Jambaya’s wife later called me and informed me that my wife was dating Jambaya. She revealed that she came across messages in her husband’s phone, with my wife apologising to him after I had confronted him.
“She also said Jambaya had already secured lodgings for my wife so that she could leave me for good. I recorded this call and I can play it in this court,” narrated Mabika.
However, Jambaya denied dating Mabika’s wife and asked the court to summon her to get her side of the story.
Jambaya also denied ever talking to Mabika over the phone.
However, Jambaya was left with egg on his face as Mabika provided evidence of their telephone conversation.
In trying to defend himself, Jambaya left the court in stitches when he suggested that Mabika was the one who had committed adultery by talking to Mai Jambaya.
“I don’t know his wife. May the court bring her here so that she speaks for herself. I never spoke with Mabika over the phone, maybe I was drunk. But why was he talking to my wife? Maybe they are up to something,” said Jambaya.
The Messenger of Court who served the parties with the court summons said Mabika’s wife claimed to be Jambaya’s second wife.
“We had a torrid time locating Jambaya as his workmates denied us entry into the premises. We located Mabika’s wife in UVE Section of Vengere where she told us that she is now Jambaya’s second wife. She took us to Tsanzaguru and showed us Jambaya’s house where we served him with the court summons,” said the Messenger of Court.
The court found Jambaya guilty of adultery and fined him four cattle.
Jambaya requested to hand over one beast every month starting from the end of October.
