Harare businessman Genius Kadungure who is accused of swindling two businessmen of R1, 5 million was released on Friday after spending six days in custody.He was granted US$1 500 bail last Tuesday but he remained in custody after the State invoked Section 121 of the Criminal Procedure and Evidence Act.
The section allows the State to hold suspects for a week while it considers appealing.
The State was not satisfied with the trial court decision to impose lenient bail conditions hence its appeal at the High Court to tighten the conditions.
The defence did not oppose the appeal and struck a consent order with the State before Justice Chinembiri Bhunu sitting in his chambers.
Justice Bhunu allowed the appeal and ordered an additional measure, which the prosecution requested to secure Kadungure’s court attendance.
Kadungure swindled Zanu-PF MP for Chegutu West Cde Dexter Nduna, who is the managing director of Badon Enterprises (Pvt) Ltd and a Kadoma-based miner only identified as Gatawa of R1 581 890.
Harare magistrate Mr Milton Serima granted Kadungure bail coupled with conditions that he reports five days a week, Monday to Friday at CID serious fraud and to surrender his passport.
