High Court suspends deportation of Chinese businessman

High Court Judge Justice Never Katiyo has suspended the deportation of a Chinese businessman, Haoxuan Song, who was arrested by immigration last week after he postponed the hearing of the matter to September 17.

The businessman had cited the chief director of immigration and the Minister of Home Affairs and Cultural Heritage as respondents.

Song challenged the alleged deportation saying it violated his constitutional rights.

In his urgent chamber application, Song submitted that he has been in Zimbabwe since 2004 when he was four years old after being granted permanent residence status by the chief director for immigration.

He submitted that he is a director and sole shareholder of Msasa Shoe factory in which he had invested US$3 million and also a director of Msasa ‘Textile (Private) Limited which was set up in the year 2020.

He further submitted that he had not been served with any document requiring him to leave Zimbabwe since he knew that he had been in the country lawfully and followed the conditions upon which his permanent resident permit was granted.

He said on September 13 early in the morning he learnt that officers from the immigration were camped outside his house and he called his lawyers who then attended and ushered the officers into the house.

He further submitted that the officers were looking for his mother Li Song but she was not at home and the officers searched the house and could not find her.

The immigration officers seized his passport and Zimbabwean identity card and took him to the Harare Remand Prison pending his deportation.

Song said his freedom, interests, and legitimate expectations have been affected by the conduct of the immigration officials.

His mother has been locked in legal disputes with former business partner Francesco Marconati who has been convicted three times

He is also a shareholder and director of several other companies in Zimbabwe.
