Ushewekunze Housing Cooperative chairman Fungai Nyarota has been arraigned before the courts for selling a stand illegally.
Nyarota (53) who is facing fraud charges was remanded in custody pending his bail application today.
The complainant is Ms Norah Muderere (71), a pensioner.
The State said sometime in 2014, Muderere joined Ushewekunze Housing Cooperative even though there was a land dispute
between the owners of Crest Breeders International Farm (Confederation of Farmers Industry (CFI) and Ushewekunze
Housing Cooperative over its acquisition by the latter.
An agreement of settlement was entered into between CFI and the cooperative that all agreements of sale would only be
entered into by CFI and cooperative members allocated the stands.
Tonde Nyazema was allocated stand 218 measuring 1 000 square meters by the cooperative. Nyarota then misrepresented to
Muderere that the same stand was vacant and on sale.
As a result of the misrepresentation, Muderere paid some developmental and administration fees for land.
Consequently, an agreement of sale was signed between Muderere and CFI for the ownership of the stand.
Nyarota did not disclose to CFI that the stand had been already allocated to another beneficiary.
The offence came to light when Muderere visited her stand and discovered that Nyazema had erected some structure there.
Several efforts to recover her money or the stand were in vain as Nyarota vowed not to reverse his decision.
Muderera was prejudiced of US$15 000.
