FORMER Chitungwiza housing officer Ebby Nyuke on Saturday appeared in court on allegations of selling a stand which belonged to a church.
Nyuke (39) of 14055D New Zengeza 4 Chitungwiza was facing fraud charges when he appeared before Harare magistrate Mrs Barbra Mateko.
He was freed on $300 bail.
As part of his bail conditions, Nyuke was ordered to continue residing at his given address and not to interfere with State witnesses. The court heard that on November 2017, Charisville Ministries applied for a church stand from Chitungwiza Municipality and was allocated stand number 31596 measuring 5 200 square metres in Unit F, Seke.
It is alleged that in that same year, Nyuke approached the complainant (name not supplied) and advised her that he had a residential stand number 16, Unit F in Seke measuring 300 square metres which he was offering for sale at a price of $3 000.
The court heard that the complainant viewed the stand and got interested.
It is alleged that the complainant gave Nyuke a Mazda Demio as payment towards the purchase of the stand. It is the State’s contention that an agreement of sale was drafted to this effect and signed by both parties.
The State further alleges that the offence was discovered when the complainant, who had erected a structure on the stand, was approached by Nyasha Matuta who indicated to her that the stand was within the church’s land.
The court heard that Matuta filed a case of criminal trespass against the complainant who then filed a fraud report against Nyuke, leading to his arrest.
