Intruder found stark naked in house, demands sex

A ZVISHAVANE woman recently got the shock of her life when she found an intruder, who was apparently drunk, stark naked in her house and lying on her bed.The 30-year-old Ms Dzivaidzai Ushe, of house number 38 Mandava Township in Zvishavane, could not believe her eyes when she walked into her bedroom at 10pm to find 26-year-old Khanyisiwe Tanyanyiwa sleeping on her bed in his birthday suit.

Ms Ushe was further stunned when Tanyanyiwa woke up and started demanding sex from her.

It had to take police officers from Mandava Police Station to get Tanyanyiwa to vacate Ms Ushe’s house.

Tanyanyiwa appeared before the Zvishavane magistrate’s court on Tuesday last week, facing charges of unlawful entry as defined in section 131 of the Criminal Law (Codification and Reform) Act, Chapter 9:23.

He pleaded not guilty to the offence, but Zvishavane magistrate Mr Story Rushambwa found him guilty and sentenced him to 12 months in prison.

Tanyanyiwa will, however, serve an effective six months after the other six months were suspended on condition of good behaviour.
In his defence, Tanyanyiwa justified his refusal to leave the complainant’s house saying he had met Ms Ushe, whom he claimed was a prostitute, at a local bar and had hired her for the night.

“Ndangandisingafaniri kubuda mumba umu nekuti ndaida bonde nemukadzi uyu. Ndakamukecha tikatenderana kuti taizorara tese usiku hwese. Ndakatoshamisika kunzwa ava kunditi buda muno asi isu tanga tabvumirana pakutanga. (I wasn’t supposed to leave her house because I had hired her for her services. She is a prostitute and we agreed that I would spend the night at her house. I was surprised when she turned and started chasing me out of her house when we had initially agreed that we would spend the night together),” Tanyanyiwa told the court.

However, Ms Ushe denied ever meeting Tanyanyiwa prior to their shock encounter in her bedroom when she found him sleeping naked on her bed.

She also denied being a prostitute or patronising bars as claimed by Tanyanyiwa.

“Handisi pfambi ini uye zve handipindi mubhawa ini sezvaanoreva murume uyu. Murume uyu handimuzivi uye ndanga ndisati ndambosangana naye kusvika musi wandakamuona avete pamubhedha wangu manheru. (I’m not a prostitute and I don’t partronise bars as alleged by this man. I don’t know him and I had never met him until the night I saw him sleeping on my bed in my house),” said Ms Ushe.

The case against Tanyanyiwa, as presented by Mr Stanely Ncube, are that on 15 May this year, Tanyanyiwa entered the complainant’s house through the front door which was closed but unlocked.

There was no one in the house when Tanyanyiwa got inside and made himself comfortable on the complainant’s bed.

The court heard that when the complainant, Ms Ushe, walked in at around 10pm she was surprised to find a stranger, Tanyanyiwa, naked and fast asleep on her bed.

Ms Ushe woke Tanyanyiwa up, who after waking up started demanding sex, claiming that the complainant was a prostitute he had hired for the night.

Mr Ncube further told the court that efforts by the complainant to make Tanyanyiwa leave her house were unsuccessful as the latter insisted that he would not leave before having sex with her.

Shocked by Tanyanyiwa’s claims and antics, Ms Ushe rushed to Zvishavane Police Station where she reported the matter.

Police officers who attended the case found Tanyanyiwa still in Ms Ushe’s house adamant that he would not leave until he had had sex with the complainant.
