It’s R38 000 or jail

for defaulting on monthly payments of R11 000 for his ex-wife and four children’s upkeep – has been ordered to pay R38 000 or face eight months imprisonment.
His ex-wife Margaret dragged him to court for failing to look after his four children and dumping them so that he could live with another woman.
Mufokozana was recently arrested on charges of criminal contempt of court.
He denied the charges saying he had been taking care of the children since the marriage broke down. However, Beitbridge resident magistrate Miss Gloria Takundwa on Tuesday sentenced him to 12 months imprisonment.
She suspended four months of the sentence conditionally for five years and a further 8 months were suspended on condition he pays the arrears of R38 000 by April 30.
On December 8, 2011 the court said he should pay R11 000 monthly as maintenance.
Bernard did not pay a cent of that money.
He was then arrested on March 7 when the arrears had reached R38 000.
The couple is awaiting finalisation of its divorce case.
In her founding affidavit in that matter, Margaret – who is being represented by Mr Tawanda Kanengoni – alleges that Bernard left the matrimonial home in 2009 after starting an adulterous affair with another woman.
Bernard operates a trucking business while Margaret is not employed. – CR.
