Kereke blasts ‘unethical’ lawyers

Rock Foundation Medical Centre owner Dr Munyaradzi Kereke yesterday filed a complaint with the Law Society of Zimbabwe against two lawyers he accused of unethical and fraudulent conduct in the case in which nearly 100 employees want to place his hospital under provisional judicial management.
The workers filed an application at the High Court seeking an order for the hospital to be placed under judicial management, claiming it has failed to pay creditors US$5 million.

Dr Kereke, who is also legislator for Bikita West, accused lawyers Ms Monica Jera of Mpame and Associates and Mr Kevin Musoni of Musoni Law Chambers of improper conduct.

He said Ms Jera fraudulently commissioned 89 forged affidavits filed at the High Court under case number HC4425/ 14.
In respect to Mr Musoni, Dr Kereke said the lawyer filed the 89 fraudulent affidavits and fabricated financial records of RMC.

Dr Kereke said by claiming that 89 affidavits were before her and proceeding to certify them, Ms Jera abused the Commissioner of Oaths powers because the 89 affidavits were fraudulently drawn and not signed by the purported RMC Hospital employees.

“Monica Jera acted fraudulently, unethically and maliciously with defamatory consequences to the RMC Hospital, Rock Foundation Family Trusts and my good name,” said Dr Kereke.

“This conduct brings the legal profession into irreparable disrepute, more so when such cooked up documents were presented in a formal High Court application.”
Musoni, who is acting for the applicants, filed the affidavits at the High Court. Dr Kereke said Musoni and company also submit to the High Court fabricated financial statements for the RMC Hospital, in a clear intention to cause crippling harm to the hospital, its patients and owners.

“Given the gravity of the matter at hand where registered lawyers wilfully elected to commit fraud and fed the High Court with fraudulent false information in a bid to fast track the placement of the RMC Hospital under judicial management, we pray that the LSZ takes punitive measures against these wayward legal practitioners,” he said.

Mr Musoni yesterday refused to comment on the matter, saying he would do so today, while Ms Jera could not be reached for comment.
