The complainant Choi Kwang Sei is a permanent resident in Zimbabwe. It is alleged that sometime in October 2009, Sei approached Charles Phillip Tapiwa Mbanje intending to rent part of Reliance building for a shop and the pair agreed on certain terms.
Sei, it is alleged, was asked to pay US$25 000 as goodwill for a two-year period and monthly rentals of US$2 170.
Mbanje allegedly convinced Sei to enter into a partnership agreement to avoid eviction from the premises by the owners of the building.
Sei moved his equipment into the shop and started renovating the offices after paying a total of US$28 800, argues the State.
Mbanje later evicted Sei for undisclosed reasons.
Sei reported the matter to the police after Mbanje allegedly failed to pay him his refund.
Police investigations revealed that Mbanje allegedly leased property that did not belong to him.
Mbanje recently appeared in court after he was summoned for trial.
However, the trial failed to open after provincial magistrate Mr Kudakwashe Jarabini ruled there was improper service of summons.
Instead of summoning Mbanje as an accused, he was subpoenaed as a State witness hence the magistrate’s ruling.
