Landlord drags defiant tenant to court

A HARARE landlady has been granted a protection order against her tenant, whom she accused of insulting, harassing and taking her cabin without her consent.

Rejoice Sibanda appeared before Harare Civil Court Magistrate Ms Johanna Mukweshe, alleging that her tenant, Kudzanai Chipinza, has not paid rent for 15 months.

She told the court that Chipinza once threatened her with a shovel after she confronted him.

“He took a shovel and pointed it at me, threatening to use it if I did not leave,” she said.

“I am now scared to even ask him about the remaining balance.”

Sibanda asked the court to order Chipinza to return her cabin, which he sold.

”I had a cabin on the property he is renting from me and he sold it, now, I want it back,” she said.

She also told the court that she doesn’t want him to stay on her property anymore and asked the court to order him to vacate.

Chipinza denied the allegations that were levelled against him.

“I have never harassed her, she’s the one harassing me over a property that is not hers,” he said.

“I pay rent to her sister, who is the rightful owner, but she keeps demanding that I pay the money to her instead.”

He told the court that he doesn’t have any issues with the order being granted because he has never breached her peace.

Magistrate Ms Johanna Mukweshe granted a protection order in favour of Sibanda, which restrains Chipinza from insulting or harassing her.

Sibanda was advised to apply for an eviction order to have Chipinza removed from her property.
