In her announcement Ms Dziva said she had received a court application from Messrs Bhasikiti and Butau seeking to interdict the declaration of their seats vacant.

She said the Speaker could not be stopped from exercising her constitutional duty on a basis of a mere court application. Ms Dziva said notification to parliament by the party concerned was all that was required to satisfy the requirements of the law before declaring the seat vacant.
