A CITY LAWYER has landed in hot legal soup, after allegedly stabbing his own client in the back by consenting to a peace order, despite being instructed to oppose it!
Simon Muyambo (70), a hard-of-hearing senior citizen, is fuming with rage and frustration after his former lawyer, Prince Ngwenya, allegedly sold him out in court.
According to court papers, Muyambo had been dragged to court by Owen Nare, who applied for a peace order against him. Desperate to fight back, he hired Ngwenya to oppose the order. But what happened next shook him to the core.
“I told my lawyer clearly to oppose it. But during the hearing, he never explained what was going on. I later found out he had agreed to everything without telling me,” said the devastated Muyambo.
Muyambo, who relies heavily on legal guidance due to his hearing difficulties, said he felt completely blindsided by the lawyer’s actions.
“I never consented to that order. Finding out what had happened left me so stressed, I suffered a stroke. I’ve been immobile ever since,” he added, his voice shaking with emotion.
He filed an urgent plea for the peace order to be revoked, saying it was never his will to accept it, and that his rights had been trampled by someone he trusted to defend him. But in a devastating blow to Muyambo, Magistrate Challenge Mahembe dismissed his application, stating the court was bound by the law.
“Section 388 does not provide for the revocation of a peace order. The court cannot authorise what is not permitted by statute,” he ruled.
Now, Muyambo is left paralysed, emotionally wounded and with no legal relief, a man who went to court seeking justice, only to leave with a stroke and a shattered sense of trust.
