LUNAR Chickens, a company owned by former Reserve Bank of Zimbabwe Governor Dr Gideon Gono, has been ordered by the High Court to pay US$18 000 to the National Employment Council for the Agricultural Industry.
High Court Judge Justice Loice Matanda-Moyo ruled in favour of the NEC for Agriculture after Lunar Chickens failed to remit money deducted monthly from its workers for some time.
Lunar Chickens did not oppose the application and Justice Matanda-Moyo granted a default judgment.
The judge ordered Lunar Chickens to pay interest at the rate of 5 percent per annum calculated from August 7 2014 to the date of payment in full.
According to the application by the NEC, Lunar Chickens was obliged in terms of Statutory Instrument 101/2010, to deduct US$1 monthly from each employee’s gross monthly salary and allowances.
Lunar was obliged to add another US$1 to each employee’s contribution and remit US$2 per employee to NEC.
Lunar Chickens reneged on its obligation, prompting the NEC to issue out summons.
“In breach of Statutory Instrument 101 of 2010, the defendant has failed to remit the dues as at and as when they became due.
“The defendant has accumulated an outstanding US$18 054 as at December 2013.
“Despite demand, the defendant has failed and or neglected to pay its indebtedness to the plaintiff,” read the papers.
Lunar Chickens did not respond to the summons, a development that resulted in the NEC applying for a default judgment.
