Madzibaba Nzira faces eviction

In the summons that were served on the Messenger of Court in Chitungwiza last Friday by Mr Rifiloe Chanaka of Thondlanga and Associates, the Mhundwa family argues that the church was clinging on to the family land.
The church, according to the court papers, had been allowed to temporarily occupy the land for years and it is now reportedly refusing to pave way for the Mhundwa family.
The church is yet to respond to the summons.
It is claimed that Harava District Council allocated the land to members of the Mhundwa family in 1992. A copy of a letter confirming the allocation was attached to the summons.
The church is said to have asked for permission to temporarily use the land for church services and the family agreed. It is alleged that when the family wanted to use the land, letters were written to church elders but the church has not complied.
The family members feel the land was rightfully theirs and that the court should grant an order evicting the church and all those claiming ownership through it from the land.
The papers have since been filed at the Chitungwiza Civil Magistrates’ Court and the church is yet to respond.
