Magistrate dismisses application for Katsimberis to question State witness

Harare magistrate Mrs Vongai Muchuchuti Guwuriro yesterday dismissed an application by property developer George Katsimberis’ lawyer, who wanted his client to put questions to a State witness.

In dismissing the application, Mrs Muchuchuti-Guwuriro said the court cannot allow a procedure which is not sanctioned by the law.

Katsimberis is facing fraud allegations after he allegedly built a showroom in a joint venture agreement without an approved plan.

The trial resumed on Monday with State witness Allen Matambo telling the court that the City of Harare revokes building plans which do not undergo all the necessary procedures.

Matambo who is employed by the City of Harare as a plan and records officer said although the stamps on Katsimberis plans are authentic the process of approval was not followed.

He said approval is a process and the stamps are supposed to be put upon completion of the full procedures.

The matter was deferred to today for cross-examination.
