A 34-YEAR-OLD Gwanda man bit off his uncle’s finger accusing him of causing his arrest for dagga possession two years ago. Trust Nare of Mathengwane village in Guyu area appeared before Gwanda magistrate Olivia Mashava Mashaire facing a charge of assaulting his uncle, Cain Mguni, 65.
He pleaded not guilty but was convicted due to overwhelming evidence.
Nare was sentenced to 18 months in prison and six months were suspended for five years on condition he does not commit a similar offence within that period.
He will serve an effective 12 months jail term.
Mguni told the court that his nephew, who was drunk, accused him of causing his arrest in 2012 when he was convicted for possessing dagga.
“We had a misunderstanding because he accused me of selling him out to the police in 2012 yet I don’t even know anything about the case and how he got arrested. As a result, he attacked me, hit me with a stone and when I tried to run away, he got hold of me and bit my finger, removing the front part,” Mguni said.
Prosecuting, Edward Ndlovu narrated how Nare assaulted his uncle on October 30 this year.
“The complainant was drinking beer with the accused person and other villagers at Progress Mguni’s homestead in Mathengwani village. A misunderstanding arose between the accused person and another young man, Ngqabutho Nyathi, who was also drinking beer with them,” the court heard.
“After a short while, the accused person followed the complainant and accused him of getting him arrested by police in 2012. The accused person kicked the complainant on the stomach and indicated that he wanted to fight with him,” Ndlovu said.
Thereafter, Nare hit Mguni with a stone on the head, drawing blood.
“The accused person followed complainant and bit him on the left forefinger removing the front part completely,” the court heard.
Mguni managed to escape and made a report to the police, leading to Nare’s arrest.
